The Ordinance on Facilities for Handling Substances Hazardous to Water (AwSV) was announced in the Federal Law Gazette on April 21, 2017 and came into full force on August 1, 2017. The regulation replaces the previously applicable state regulations and regulates the classification of substances and mixtures according to their danger, the technical requirements that systems that handle these substances and mixtures must meet, and the obligations of the operators of these systems.

The main contents of the JGS regulation at a glance
The operator of a plant is obliged to classify the substances and mixtures that he handles in a plant as not hazardous to water or in one of three water hazard classes. This does not apply if the result of such a classification is already available and has been published by the Federal Environment Agency. The data that he needs for the classification corresponds to that required by European hazardous substances law, so that the effort for him is limited. The water hazard classes then form the basis for risk-oriented safety equipment for the system.
The basic technical requirements for these systems are that containers containing water-polluting substances are sealed throughout the entire period of operation and the operator must ensure that this condition is maintained. Should a container become leaky, technical and organizational measures must be taken to prevent damage to the water. In systems with greater risk potential, facilities must therefore be available in which the water-polluting substances released in the event of an accident are contained without human intervention and which, if necessary, trigger an alarm in order to be able to combat the damage as quickly as possible.
Since the basic technical requirements for some systems cannot be fully met, for these systems - such as handling facilities with solid water-polluting substances, hydroelectric power plants or biogas plants – Requirements that deviate from these requirements are made.
The operator is responsible for the proper operation of his system. Nevertheless, it has proven to be a good practice for systems with increased risk potential to be regularly inspected by external experts to ensure that the systems are operated trouble-free according to human judgment. The regulation regulates the requirements for the recognition of expert organizations that inspect these systems and sets certain minimum requirements that their auditors must meet.
As a further component of the security philosophy Work on the systems that is important in terms of safety can only be carried out by specialist companies, which are monitored either by expert organizations or by quality and monitoring communities. These quality and monitoring communities were previously anchored in building law and will in future be regulated by water law with regard to the requirements they must meet. However, the quality level of a specialist company is independent of who monitors it. His expertise and experience are crucial.

The AwSV also contains Regulations on the construction of JGS systems that comply with the EU-Nitrates Directive in a national action program to protect waters from nitrate discharges from systems in accordance with Section 62a of the Water Resources Act (W.H.G.) must be established. A strategic environmental assessment (SUP) in which the direct and indirect environmental impacts of the implementation of the program are identified, described and evaluated.
